County Clerk


The County Clerk is a constitutional Officer elected every four years by the voters of Washington County. The County Clerk provides service to the County Board of Supervisors and the general public and acts as an agent and representative for the State of Wisconsin through clerical assistance, issuance and distribution of licenses, election coordination, and maintaining records. Central Reproduction and Mail Service is provided through the County Clerk.

Absentee ballots must be requested and obtained from your Municipal Clerk. Please review the information on the Wisconsin Election Commission's (WEC) website regarding the process and procedure for requesting an absentee ballot.

All dogs five (5) months of age or older require a dog license. Several municipalities in Washington County also require cats to be licensed. Dog Licenses are obtained from your local municipal treasurer. A certificate of rabies vaccination must be presented to the collecting official before a dog license may be issued. Rabies vaccinations can be obtained through your local veterinarian. Dog owners should notify their municipality if their dog is given away or has died so that you will not be considered delinquent. Wisconsin State Statutes require that all dogs be licensed and vaccinated against rabies.

Every person seeking public office needs to register with the appropriate filing officer as soon as the person has the intent to run for office.

The Washington County Clerk is the filing officer for the following offices:

RESIDENCY REQUIREMENTS
Wisconsin residents must apply in the county in which one or both have resided for at least 30 days prior to application. If both parties are residents of another state, application must be made in the county where the ceremony will take place.

LICENSE FEE
A fee of $110 to be paid at the time of application is required. We do not accept credit cards, debit cards, or out-of-state checks.  There will be an additional $2.00 fee if the license is to be mailed.  Sorry, no refunds.

AGE REQUIREMENTS
Applicants must be at least 18 years-old. If a person is 16 or 17 years of age, a license may be issued with the notarized written consent of the person's parents, guardian or custodian. Consent forms are available in the County Clerk's Office.

REQUIREMENTS
Failure to meet the following requirements will delay the issuance of your license.

  • Both parties must present proof if identification.  This is a valid (not expired) driver's license or state photo ID. 
  • Both parties must provide proof of 30 day residency, with at least one residing in Washington County.  If a current address is not shown on the valid driver's license, a utility bill or government mail addressed to that person, with a date at least 30 days old, must be presented. 
  • Applicants, regardless of age, must present a STATE CERTIFIED birth certificate, which has a raised seal and lists the full first and last names of the applicant's parents. If you were born in Wisconsin, you can obtain a state certified birth certificate from any Register of Deeds in the State. Please DO NOT bring in any of the following: hospital certificate (usually with footprints), baptismal certificate, birth registration, or a photocopy of a birth certificate, as these items are not acceptable.
  • If either party has been previously married, a signed copy of a judgment of divorce, state annulment paper, or death certificate from the last marriage must be presented.
  • Date and location of ceremony (Name of Wisconsin county as well as the township, village or city where the ceremony will take place.)
  • Name, address, and telephone number of person performing the ceremony.
  • Both applicants must provide Social Security numbers.
  • Couple must apply in person at the same time.
  • Premarital medical exams and blood tests are not required.
  • All required documents must be in English.  Original documents in a foreign language must be presented along with a notarized translation into English.

WAITING PERIOD
There is a six-day waiting period, not including the day of application, after which the license is effective for 30 days including the day of issuance.   As a general rule, applicants should apply no less than 8 days and no more than 36 days prior to their ceremony. In some instances, a waiver may be granted in advance at the discretion of the County Clerk, due to unusual circumstances.  The cost of the waiver is $25.00. Waivers will not be granted to anyone under the age of 18. 

DIVORCED PERSONS
Persons divorced must wait six months from the date of judgment before marrying. This applies to both Wisconsin residents out-of-state residents. Marriages of Wisconsin residents outside the state and contrary to Wisconsin laws are null and void in Wisconsin. Marriage in Wisconsin by a person residing in another state is prohibited if such marriage would be void in the home state or jurisdiction of the person.

EXPIRATION OF LICENSE
The license is valid for 30 days including the date of issuance. The marriage must be performed within this period.

WITNESSES
Two adults, in addition to the officiant, are required to witness the ceremony and sign the marriage license.

*Commissioner Dolores Bomrad will perform ceremonies at the Courthouse if the Court Calendar permits. Dates are limited.  There is a non-refundable $75 facility use fee for ceremonies performed at the Courthouse.  Courthouse ceremonies must be scheduled in advance through the County Clerk's office at (262) 335-4301.
  

The Assistant Family Court Commissioner and Supplemental Court Commissioners do not perform ceremonies at the Courthouse. There is a fee charged for their services.


 
MARRIAGE IN A FOREIGN COUNTRY
When someone is married out of the United States, it is their responsibility to obtain the proper legal paper(s) from that country. It is important to get certified copies before you leave the foreign country and, if the certificate is in a foreign language, you should obtain notarized translations of the document. This document will be your only proof of marriage. If a marriage is performed in a foreign country, a marriage license cannot be filed in Wisconsin.

How to Obtain a Passport

The Washington County Clerk is a designated acceptance facility for obtaining a U.S. Passport. You will not receive your passport from us. Our role is to accept completed passport applications and fees for processing.

PASSPORT BOOK
If 16 years of age or older, the Passport Book processing fee is $110 payable to "U.S. Department of State" and the separate execution fee is $25 payable to "Washington County Clerk."

PASSPORT CARD
The Passport Card is a U.S. Passport issued in card format. Like the traditional Passport Book, it reflects the bearer's origin, identity, and nationality and is subject to existing passport laws and regulations. Unlike the Passport Book, the Passport Card is valid only for International travel by land or sea between the United States, Canada, Mexico, the Caribbean and Bermuda. It is not globally interoperable and is not valid for travel by air to or from any foreign destination."

If 16 years of age or older, the Passport Card processing fee is $30 payable to "U.S. Department of State" and the separate execution fee is $25 payable to "Washington County Clerk."

If 15 or younger, the Passport Card processing fee is $15 payable to "U.S. Department of State," and the separate execution fee is $25 payable to "Washington County Clerk." 

If applicant is under the age of 16, both parents or legal guardians must show valid identification, sign and take an oath before a passport acceptance agent.

Separate checks for each application is required by the U.S. Department of State.  The $25 processing fee for each application payable to Washington County Clerk can be cash or check. Please do not bring cash for the Passport Application. Our office cannot accept credit cards, debit cards, or out-of-state checks. By law, the passport processing fees and execution fees are non-refundable.

REQUIREMENTS
All applicants must appear in person. Along with the passport application, you must submit the following:

  • Proof of U.S. Citizenship
  • Proof of Identity
  • One Photograph

Proof of U.S. Citizenship
ONE CERTIFIED copy of a birth certificate issued by the county or State serves as evidence of citizenship. It must have the seal of the issuing office and the filing or registration date, which must be within one year of birth.  Wisconsin birth certificates are available in any Register of Deeds office in the state of Wisconsin.

If you are 18 or older and have an expired passport, you are required to submit the passport rather than a birth certificate.

When renewing a passport for an applicant under the age of 16, you must include ONE CERTIFIED copy of the child's birth certificate, which includes the full names of the parents, as well as the previous passport.   Please see the application for additional information for obtaining a passport for a child under the age of 16.

Naturalized citizens must present their original Naturalization Certificate.

The U.S. Department of State will keep one certified copy of the birth certificate for their records.  The other evidence of citizenship will be returned with your passport.

NOTE: Hospital, baptismal, birth registrations or photocopies of birth certificates are not acceptable.

Proof of Identify
Identification that includes your signature and physical description or photograph such as a valid driver's license or a Federal, State, or Municipal identification card qualifies as proof of identity.

PHOTO SERVICES
Passport photo services are available in the County Clerk's Office.

Fee is $11.

One Photograph
One professional passport photo (2 x 2 inches) is required. Digitized photos will be accepted at the discretion of passport Services. School photos are not acceptable.  EFFECTIVE NOVEMBER 1, 2016, CUSTOMERS MUST REMOVE THEIR EYE GLASSES WHEN TAKING A PHOTO FOR A U.S. PASSPORT.

Complete all requested information on the application form. If all requirements are not met, the County Clerk's office cannot accept the application for processing.

EXPEDITED SERVICE
For normal processing, Passports should be received in approximately 4 - 6 weeks.

For faster processing, you may request expedited service and pay an additional fee of $60. You should receive your passport in approximately 2 - 3 weeks. The County Clerk's office cannot accommodate overnight deliver.

ADDITIONAL INFORMATION
Do not sign the passport application until you are instructed to do so by the Passport Agent in the County Clerk's office.

Photocopies of the passport application will not be accepted.

 Washington County hereby offers to sell the following tax delinquent real estate.

This notice is published and sale shall be conducted in accordance with Section 75.69 Wisconsin Statutes, and Chapter 4 of the Washington County Ordinances. All bids shall be for the property “AS IS, WHERE IS, AND WITHOUT CONDITIONS”.

All bidding is being conducted on the Wisconsin Surplus website. Go to WisconsinSurplus.com to view parcel details, to learn about bidding online, to register to bid, and to place a bid. Bidding will commence on Thursday, November 9, 2017 and will end on Monday, November 27, 2017 at Noon (CST), subject to staggered ending time rules of Wisconsin Surplus. Questions may be directed to Wisconsin Surplus by calling 608-437-2001, or by calling the Washington County Clerk’s Office at 262-335-4301.

At the end of the sale, the highest bidder shall pay to Wisconsin Surplus a minimum of 10 percent (10%) of the bid amount as earnest money in the form of certified check or cashier’s check. The ten percent (10%) earnest money shall be received by Wisconsin Surplus no later than 4:00 p.m. on the next business day after the close of the sale. All earnest money shall be non-refundable.

All bids will be publicly awarded before the Washington County Board of Supervisors on Tuesday, December 12th, 2017 at 7:30 a.m. (CST) in Room 1019 of the Washington County Government Center, 432 E. Washington St., West Bend, WI, 53095. Successful bidders shall remit payment, according to rules of Wisconsin Surplus. A Quit Claim Deed will thereafter be issued. Prior years’ taxes, interest, and penalty will not be the responsibility of the successful bidder. New owner will be subject to current and future real estate taxes and may be responsible for any outstanding special assessments or charges due to the local municipality.

Washington County may accept the bid most advantageous to it. Bids that are less than the appraised value (Minimum Bid) of the property shall not be considered.
